Although the Sole Representative of an Overseas Business route has been closed since 11 April 2022, those who have permission to stay in the UK under this route can apply for their stay for another 2 years and are able to apply for settlement in the UK after 5 years staying in the UK.

1. Requirements to apply for extension application of Sole Representative of Overseas Business Visa

 

In order to be able to apply for an extension under this route, you have to satisfy the following requirements:

  • You have established and registered the business in the UK;

  • You have been working full-time at the business in the UK and must supervise that business;

  • You are required by your employer to continue in your role.

2. Key documents you need to prepare for the extension application of Sole Representative of Overseas Business Visa

3. Requirements to apply for settlement under the Sole Representative of Overseas Business Visa route

 

If you are staying in the UK under the Sole Representative of Overseas Business route, you are allowed to apply for settlement in the UK once you satisfy the following key requirements:
 

  • You have spent a continuous period of 5 years in the UK;

  • The business you established in the UK and the overseas business must have been actively trading;

  • You must have worked full-time for the business you established in the UK or your employer who is the overseas business;

  • You must not have had majority control in the overseas business in the UK;

  • You must pass the B1 English Language test in speaking and listening skills.

 

4. Key documents you need to prepare for the settlement applications under the Sole Representative of Overseas Business Visa route

 

In order to prove that you satisfy the above requirement, you have to provide the following key documents:

  • Evidence showing that you have been working full-time at the business you established in the UK or your employer;

  • Evidence showing that you have been living in the UK for a continuous period of 5 years under the Sole Representative of Overseas Business route;

  • Evidence showing that the UK business and the overseas business have been actively trading;

  • Evidence showing that you do not have majority control in the oversea business in the UK.
