Turkish Businessperson Visa

A Turkish Businessperson Visa application enables a Turkish National to enter and establish a business in the UK under the terms of the Ankara Agreement on 12 September 1963 with the general aim of promoting economic relations between Turkey and the European Community and the eventual accession of Turkey to the Community.

 

Following the UK’s departure from the EU on 31 December 2020 all new entry clearance and in country applications have stopped for new entrants under this route.

 

However for those that were granted this visa having made an application before 31 December 2020 can continue to extend their visa and settle in the UK, the application is now referred to as a ECAA application or Turkish Businessperson Visa application.

1. What is a Turkish Businessperson Visa Application?

 

The relevant applications referred to below apply to ECAA businesspersons and their family members.

 

If you are already in the UK as a Turkish Businessperson you can apply to extend you visa to stay in the UK.

 

After applying for the visa you can continue running your business in the UK and start another one if you want, or you can continue to help run an established business in the UK as you were prior to the UK withdrawing from the EU due to Brexit.

With a Turkish Businessperson visa extension application once granted you can:

  • keep running your business in the UK, and start another one

  • keep being a partner in an existing business which you’ll have an active part in running

  • apply to extend your stay if you meet the eligibility requirements

  • study

  • do voluntary work

  • apply to settle permanently in the UK (also known as ‘indefinite leave to remain’) if you’ve lived in the UK for 5 years and meet the other eligibility requirements

To apply for an extension you have to meet many requirements, some of these are eligibility requirements which include but are not limited to:

  • have a valid Turkish Businessperson visa

  • show that whilst in the UK you have not broken any immigration laws

  • keep running a viable business which you must provide evidence for

  • keep being able to pay your share of the costs of running the business which you will need to provide evidence of

  • show that your share of the profits continue to be enough to support you and your family without your needing to have another job and that you have not received any public funding

  • If you are part of an existing partnership or company you’ll need to show that you still have an active part in running the business.

 

There are various other requirements and evidence that you have to provide in order to satisfy the Home Office that you should be granted an extension under this route which we can advise you on once instructed to act on your behalf.

This visa allows a Turkish national to establish any viable business in the UK as long as you can show that you can meet the business and personal liabilities.

 

As the route is now closed for new entrants it is important that your extension application is prepared with very careful assistance, the benefit of being able to stay on this route means that you can continue to operate your business, have your family members join you and also settle after 5 years in the UK under this route.

 

3. What are the requirements for a Turkish Businessperson Visa Extension Application?
